The epic struggle over intellectual property rights in the manufacture of smart phones took a dramatic turn with Bollywood actress Bipasha Basu entering the fray by seeking over $1 billion in damages from electronic giants Apple and Samsung for design patent infringement. The Bengali bombshell contends that her well rounded, curvaceous figure was the inspiration behind the “rectangular with rounded corners” design of the wildly popular smart-phones manufactured by Apple and later by Samsung.
Bipasha says a considerable amount of hard work, trial and error, and innovation in the form of innumerable crash diets, countless gym sessions, and surgical interventions have gone into shaping her lissome figures and delectable curves and to have them now be effortlessly ripped off by smart-phone manufacturers has left her deeply anguished.
“I’m cool with a little bit of copying, yaa. After all, I’m from Bollywood. But Apple’s blatant plagiarism has broken my heart and shaken my faith in protection of intellectual property rights in free market economies. Even Pritam is not so blatant, yaa. I didn’t feel this bad when even John dumped me,” sniffed Bipasha to The Unreal Times Bollywood correspondent, Tara Sharma.
Apple has rejected the Bollywood diva’s charges, asserting that “her sexy figure was indeed a source of inspiration but to describe their design as a straight rip-off would be a distortion of the truth”. “Clearly, Ms. Basu has a flawed notion of how innovation works in Apple. Our engineers spent years studying not just her figure but those of Bebo, Ash and other beauties as well before locking in on the iPhone’s final shape. So to term it as a straight rip-off is an insult to the creativity, imagination, and hard-work of Apple’s engineers and diminishes their immense R&D efforts,” said Apple CEO, Tim Cook.
Samsung’s response was more guarded. “We would normally have been laughing our butts off over this development but after an American jury ruled that Apple indeed owns a patent design over rounded corners, we are not taking this lightly. For the record, our inspiration for the Samsung smartphone’s shape was Kim Kardashian,” disclosed Samsung CEO, B D Park.
